Scope of Services

We provide business financing services, including business loans, lines of credit, equipment financing, merchant cash advances, revenue-based business loans, working capital loans and similar products (collectively “Financing Products”). You are responsible for providing accurate and complete information required for applications. Approval and funding of Financing Products are subject to our review, underwriting and approval.

Eligibility & Application

You represent that you are legally capable of entering into these Terms, are at least 18 years old (or the legal age in your jurisdiction), and that you are authorized to apply for business financing on behalf of the business. You agree to provide true, accurate, current and complete information and to update it as necessary. We reserve the right to decline, suspend or revoke access to the Services and to terminate your financing if fraudulent or inaccurate information is provided.

User Accounts; Access

If you create an account on the Site, you are responsible for maintaining the confidentiality of your credentials and are fully responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use or breach. We may suspend or terminate your account for any reason, including breach of these Terms.

Fees, Interest & Payment Terms

When you apply for a Financing Product, you will receive terms including amount, fees, interest (or factoring rate, if applicable), term length, payment schedule and other details. Your obligation to repay and make payments is governed by that separate financing agreement. These Terms do not replace or modify your specific financing contract unless explicitly stated. Late payments may incur additional fees and/or interest as set out in your financing agreement.

Prohibited Uses

You agree not to use the Site or Services for any unlawful purpose or in any way that disrupts, interferes with or harms our operations. Prohibited uses include, but are not limited to:
Using the Site to submit false or misleading information.
Attempting to gain unauthorized access to the Site or other accounts.
Reverse-engineering, scraping or mining data from the Site without permission.
Transmitting any viruses, malware or harmful code.
Using the Site to promote illegal activities or infringe the rights of others.

Disclaimers and Limitation of Liability

Disclaimer of Warranties: The Site and Services are provided “as is” and “as available” without representations or warranties of any kind, whether express or implied. We do not guarantee that the Services will meet your needs, that funding will be approved, or that funds will always be available.
Limitation of Liability: To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to your access to or use of the Site or Services (including lost profits, business interruption or loss of data), even if we have been advised of the possibility of such damages. Our total liability for direct damages shall not exceed the amount you paid us in the past 12 months or, if no such payment, USD 100.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively by the state or federal courts located in Sacramento County, California. You consent to the personal jurisdiction and venue in those courts.

Entire Agreement

These Terms, together with any financing agreement you enter via us, constitute the entire agreement between you and Elite Funding Group regarding your use of the Site and Services and supersede all prior or contemporaneous communications and proposals (whether electronic, oral or written).
